Usage and Access Terms
Our website provides a platform allowing hospitality companies and vendors to interact with users and job-seekers for the purpose of researching and locating prospective employees. This allows our customers to access, view, and read resumes; job posts; and job descriptions; as well as sending messages and/or texts to other users, companies, or prospective employees through our app or website.
The following terms relate to a user’s usage and access of our website and services, and are supplemented by our policies and Rules of Behavior.
You may not: (a) download, copy, or transmit any content from our website in violation of this Agreement, or without our company’s written permission; (b) use data mining, robots, or similar data extraction methods; (c) manipulate or otherwise display our content by using framing or similar navigational technology; (d) register, subscribe, unsubscribe, or attempt to register, subscribe, or unsubscribe any person, user, company, or other person for a product or service unless you have their permission to do so; and (e) use our website or its content other than for its intended purpose, including but not limited to: defamation; harassment; stalking; abusive or threatening behavior; or any behavior that might violate the substantial rights of others.
Users, customers, and vendors are prohibited from interfering with or infringing upon the security of our website; or otherwise abuse our system resources; services; or networks that may be connected to or accessible via our website. When you use our website, you warrant it is strictly for any legal or lawful purpose.
Intellectual Property Rights and Licensing
Each customer, user, job-seeker, and vendor is granted a worldwide, non-exclusive, non-sublicensable, and non-transferable license to use our website, products, and services. Users may review, read, or print pages from our website for their own personal use as provided within these terms, but our property and content must not be: republished; sold; rented; licensed; duplicated; displayed; or otherwise copied, used, or exploited for any commercial purpose.
Content, products, or services provided to customers or users on the website is for informational purposes only, and is to be accessed for your own personal use, under the Terms of this Agreement.
For purposes of this Agreement, “content” means, without limitation: pictures; illustrations; graphics; text; photos; videos; audio (MP3); and/or any and all recorded digital media; trademarks; marks; service marks; logos; slogans; or any other intellectual property belonging to the Company.
Registration and Services
Visitors can read and browse our website without registering for an account, but as a condition to using our services and features, you will be required to register for an account.
Vendors and hospitality companies who desire to upload a job posting will be required to remit payment per posting. Customers and job-seekers may upload and feature their resume for a period of 7, 14, or 21 days, depending upon the services chosen. Please review our fee schedule in order to determine costs for uploading job postings or featuring a resume. All payments are processed via PayPal or 2Checkout.
Users and customers warrant that they are over the age of eighteen (18), and are providing us with truthful, and complete registration information, such as: name; email address; user name; and password.
You understand and agree that it is your responsibility to keep all registration information confidential and current. If you fail or refuse to take these measures, it may be considered a breach of these Terms, which may result in the termination of your account.
Industry4hire. reserves the right to refuse registration of, or cancel any username at any time. You understand and agree that you are individually responsible for activity on your account, and in the event you believe your account security has been breached must contact Customer Support immediately at: industry4hire.com/contactpage/
We reserve the right to refuse service to any person; revise, supplement, or modify content on our website; and reserve the right to implement changes with or without notice to you.
You acknowledge and agree that it is your responsibility to make sure these Terms of Service are in compliance with all laws, rules and regulations that might be applicable to you, and your right to access our website is revoked where these Terms of Service are prohibited.
You may cancel, alter, or modify a job posting; delete a resume or change your account at any time.
You may also terminate or cancel your account by contacting customer service in writing via: industry4hire.com/contactpage/ Please note that it may take longer than twenty-four hours to delete your account from our system. Once your information is deleted from our system, you will no longer be able to access your account.
In the event you terminate your account, you will be liable and responsible for any and all outstanding costs and fees related to your account.
You understand and agree that any content you access on our website is at your own risk and you agree to accept full responsibility and liability for any damages or losses to you or any other party. “Content” includes without restriction: text; graphics; photographs; illustrations; files; code; video, audio, or media clips; comments; information; data; and any interactive features generated or otherwise made accessible via our website.
NOTICE: We retain all rights, title and interest to our website and its content which is protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws.
Vendors, customers, users, and visitors warrant not to infringe upon those rights, and to abide by and agree to all applicable copyright and trademark laws; copyright notices; logos; service marks; and any restrictions related to any content contained within our website.
Rules of Conduct
Visitors, vendors, users, and customers agree not to use our website or services for any improper, illegal, or restricted purpose.
Industry4hire has strict Rules of Conduct. Harassment, bullying, obscenities, pornography, bigotry and violence is strictly prohibited and will not be tolerated.
Users, vendors, customers, and job-seekers must not use our website in any way that causes, or may cause, damage to our website or impairs its availability or accessibility; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
You acknowledge and understand that our company does not moderate communications between users, vendors, and job-seekers. In the event any person or persons violate these terms, specifically our Rules of Conduct, will have their account automatically terminated without notice.

Customers and vendors must include their: name; email address; username; and purpose of the email. Please allow up to 48 hours for a response.
In the event you discover a billing error, or a duplicate job-posting, you must notify our Customer Support department immediately in writing, and no later than fourteen (14) days from the discovery of the error. Our Customer Support department will review the error and issue a refund on a case-by-case basis.
When contacting Customer Support, the account holder must supply: name; email address; user name; date of error; and a written description of the error. All refunds will be processed on a first come and first served basis. Please allow up to seven days for us to investigate and process refunds.
We reserve the right to terminate access to all or any part of our website or services at any time, with or without notice to you. You can cancel your account at any time by following the instructions provided on our website: industry4hire.com/contactpage/
If our company discovers that a user or account holder has supplied false or misleading account information, or has intentionally falsified a job-posting or resume, it shall be deemed a breach and violation of these Terms of Service, and their account shall be immediately terminated without notice.
All conditions contained within this Terms of Service Agreement shall survive termination, including, without limitation, warranty and legal disclaimers, indemnity, limitations of liability, and choice of law provisions.

Users, vendors, job-seekers, and visitors agree to release our company, directors, owners, employees, and agents from any and all liability related to content accessed through our website. We make no warranty, guarantee, or representation regarding content or services you access; and we will not be responsible for the correctness, copyright compliance, or legality of material contained within the website.
You understand and agree that Industry4hire, nor our directors, owners, employees, or agents, shall be liable or responsible for any injury, loss, and/or damages, resulting from your operating; using; installing; handling; or running any program; app; or service from our company or website. This may include and is not limited to: content; programs; and/or apps.
We disclaim any and all liability or responsibility, and the user warrants to release Industry4hire, our directors, owners, employees, and agents, from any and all liability or responsibility whatsoever.
Limitation of Liability
Force Majeure and Unforeseen Events
You understand and agree that we are not responsible for any delay or failure to perform regarding our website, products, or services, to the extent that a delay or failure is caused by fire, flood, explosion, strike, labor unrest, riot, embargo, act of civil or military authority, accident, acts or omissions of carriers, act of God, or other such contingencies beyond our control.
We shall attempt to provide notice of any Force Majeure event on our website as soon as possible, but you understand that use of the website or services is at your own risk.
Any and all disputes regarding these terms shall be resolved in a professional and business-like manner, absent resolution, disputes shall be resolved by mediation, located in San Diego, California, with the parties agreeing to share the cost and choice of a third party mediator.
The disputing party shall serve the non-disputing party with a thirty (30) day written notice of intent to mediate, sent to the party’s last known address, prior to seeking dispute resolution. Service shall be deemed complete upon the fifth business day after the non-disputing party’s receipt of said Notice.
The prevailing party shall be entitled to reimbursement of any and all costs and fees, including but not limited to attorney’s fees.
If any provision of this Agreement is deemed unenforceable, or invalid, the unenforceable or invalid provision shall be deemed modified to the least extent necessary to become legal and enforceable and no other provisions affected thereby.
